Web Application and Mobile App

1. Agreement to Terms

By accessing or using the OpenFIT platform (including the web application at openfit.care and any associated mobile applications), you agree to be bound by these Terms and Conditions. OpenFIT is operated by GroupNos Technologies Ltd, trading as ACE Health ("we", "us", "our"). If you do not agree to these terms, please do not use the platform.

2. Service Description

OpenFIT is a healthcare feedback platform that enables the collection of Patient-Reported Outcome Measures (PROMs) and Patient-Reported Experience Measures (PREMs). The platform is provided to you through your healthcare provider as part of your care program. Services include:

Access to the OpenFIT web application and/or mobile app

Completion of healthcare surveys and outcome measures

SMS and email notifications for survey requests

Two-factor authentication (2FA) for secure platform access

QR codes for convenient survey access

3. User Registration and Accounts

You are registered on OpenFIT by your healthcare provider. You agree to provide accurate information and to keep your contact details (including mobile phone number and email address) up to date. You are responsible for maintaining the confidentiality of any login credentials and for all activities that occur under your account.

4. Communications

By providing your contact details (directly or through your healthcare provider), you consent to receive communications from OpenFIT via the following channels:

SMS: Text messages containing survey links and authentication codes.

Email: Emails containing survey links and account notifications.

QR Codes: Your healthcare provider may also provide QR codes that link to the same surveys.

These communications are transactional and care-related. We do not send marketing or promotional messages.

5. SMS Terms

The following terms apply specifically to SMS communications:

Message Frequency: Varies based on your care program. You may receive survey requests as scheduled by your provider and authentication codes when logging in.

Message and data rates may apply. Standard carrier charges may apply. Please consult your mobile carrier for details.

Opt-Out: Reply STOP to any SMS message to unsubscribe.

Help: Reply HELP to any SMS message for assistance.

6. Email Terms

The following terms apply specifically to email communications:

Opt-Out: Click the unsubscribe link in any email to stop receiving email communications.

7. Opting Out of Communications

You may opt out of communications at any time by:

Replying STOP to any SMS message

Clicking unsubscribe in any email

Informing your healthcare provider

Please note that opting out may affect your ability to receive survey notifications and authentication codes. QR codes provided by your healthcare provider will remain functional as an alternative access method.

8. Acceptable Use

You agree to use OpenFIT only for its intended purpose of completing healthcare surveys and communicating with your healthcare provider. You agree not to:

Attempt to gain unauthorized access to the platform or other users' accounts

Use the platform for any unlawful purpose

Interfere with or disrupt the platform's operation

Share your login credentials or QR codes with others

9. Healthcare Disclaimer

OpenFIT is a tool for collecting healthcare feedback and outcome measures. It is not a substitute for professional medical advice, diagnosis, or treatment. The platform facilitates communication between you and your healthcare provider but does not provide medical services directly. Always seek the advice of your healthcare provider with any questions regarding your health.

In case of a medical emergency, call your local emergency services immediately. Do not use OpenFIT for urgent medical matters.

10. Privacy and Data Protection

Your use of OpenFIT is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the platform, you consent to the practices described in our Privacy Policy.

We process your data in accordance with applicable data protection laws, including GDPR and HIPAA where applicable. Your healthcare data is stored securely and shared only with your healthcare provider and as required by law.

11. Intellectual Property

The OpenFIT platform, including its design, features, content, and underlying technology, is owned by GroupNos Technologies Ltd and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose.

12. Limitation of Liability

To the maximum extent permitted by law, GroupNos Technologies Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of OpenFIT, including but not limited to:

Delays or failures in SMS or email delivery

Service interruptions or technical issues

Unauthorized access to your account due to your failure to protect credentials

Actions taken by your healthcare provider based on information collected through the platform

13. Indemnification

You agree to indemnify and hold harmless GroupNos Technologies Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or your misuse of the platform.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on the platform and will be effective immediately upon posting. Your continued use of OpenFIT after changes are posted constitutes your acceptance of the modified Terms.

15. Termination

Your access to OpenFIT is provided through your healthcare provider. Your account may be terminated if your relationship with your healthcare provider ends, if you violate these Terms, or if your healthcare provider discontinues use of the platform. You may request account deletion by contacting your healthcare provider or support@openfit.care.

16. Governing Law

These Terms are governed by the laws of Ireland. For users in the United States, SMS communications are provided in compliance with the Telephone Consumer Protection Act (TCPA) and applicable carrier guidelines.
